Regular Meeting

K. Metzler called the meeting to order at 7:45.  D. Schreiber motioned to seat T. Gutowski.  K. Metzler seconded the motion.

W2009-3 Activity including construction and grading within regulated area related to a proposed Recycle Facility in a Designated Industrial Zone at 262 Ruby Road (Map 42 Lot 49A, north of bus parking lot) Owner/Applicant Ruby Road Development LLC (Received March 23,2009 Decision by May 11,2009 Extension granted)

T. Gutowski recused herself.  Russell Heintz was present for the applicant.  

K. Metzler read the letter from John Ianni on the delineation of the wetlands and said the only activity in the regulated area is the storage facility.  K. Metzler asked if the site was going to be paved.  Mr. Heintz said it would be compact gravel for now and most likely paved in the future.  Mr. Heintz showed the drainage on the plans and said it will all be from surface run off.  K. Metzler asked if all the materials on site will be non-hazardous and Mr. Heintz replied yes.  D. Schreiber asked if oil/water separators would be installed in the drainage system.  Mr. Heintz said they would install hooded catch basins.  

Mr. Heintz said the plans are for a maintenance facility, parts department, and garage for equipment, office and bathroom.  

The maintenance facility and oil/water separators were discussed.  K. Metzler asked if G. Jones had been to the site and he replied yes, several times.  He said they are in the process of reclaiming the site and taking off approximately 8 feet of gravel.  

The commission looked at the report from John Ianni and discussed the plan in regards to the slopes and the wetland impact.  K. Metzler asked if the basin would be wet or dry.  Mr. Heintz anticipates it will be mostly dry.  

The commission remanded this application to staff with the following suggestions;  An oil/water separator is installed at catch basin #7.  Hooded catch basins are installed throughout the site.  A maintenance plan for the drainage system is provided and, if staff approves the activity, the applicant should come back before the Inland Wetland Commission for approval of the maintenance plan.

On the Agenda for the Public Hearing, T. Gutowski would like “Applicants” changed to “Applicant”.

W2009-11 Adoption of Forestry Regulations Applicant:  Inland and Wetland and Watercourse Commission (Public Hearing June 22, 2009)

W2009-12 Comprehensive changes to the Inland Wetlands and Watercourses Regulations, Applicant:  Inland and Wetland and Watercourse Commission (Public Hearing June 22, 2009)

On the Agenda for the Public Hearing, T. Gutowski would like the wording changed to “adoption of” rather than “changes to”.  

A brief discussion was held on the Public Hearings.  T. Gutowski would like paper copies of the proposed regulations provided to the commission members prior to the Public Hearing.

Old Business

W2003-49 Notice of Violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

K. Metzler read the letter from CT DEP on the tentative determination to renew a permit and the 30 day deadline for action on this application.  T. Gutowski asked staff to pull all the records on this application for the commission to review and she will get a copy of the permit.

 Correspondence

1.  State of Connecticut DEP letter regarding W2003-49 and the tentative determination to renew a permit.

2.  Letter from Russell Heintz of Tarbell, Heintz & Associations regarding the extension given on W2009-3.

3.  CT DEP Incident Report on a chemical spill at Fed Ex.

Minutes

T. Gutowski motioned to approve the minutes of April 27, 2009 and May 11, 2009.  D. Schreiber seconded the motion.  All in favor.   Motion carried.

Staff Report and Discussion

G. Jones said he had nothing to report at this time.

D. Schreiber and K. Metzler would like to recommend to the Board of Selectmen T. Gutowski as a full time member of the commission.

Meeting adjourned at 8:16.
